LifeLabs Canada Class Action Settlement Claim 2024, Customers Eligible for $150 per Account

The LifeLabs data breach, one of the largest in Canadian history, involved unauthorized access to the personal information of approximately 15 million customers, mainly from Ontario and British Columbia. LifeLabs discovered the cyberattack in late October 2019 and publicly announced it on December 17, 2019.

The breach involved sensitive data, including lab test results, health card numbers, dates of birth, and more, with signs that health card information dated back to 2016 or earlier.

In response, LifeLabs took immediate measures to secure and strengthen their systems, including working with cyber security experts to retrieve the data through payment to the attackers, engaging law enforcement for investigation, and offering affected customers one year of free protection services that included dark web monitoring and identity theft insurance.

A class-action lawsuit was filed against LifeLabs, alleging negligence and breach of privacy. In August 2023, a proposed settlement agreement was reached, which was later approved by the Ontario Court.

Multiple law firms across Canada are involved in representing the settlement class members. The legal fees and expenses approved by the court will be deducted from the settlement fund before disbursement to claimants.

On October 25, 2023, the Ontario Court approved a Canada-wide Settlement Agreement and Distribution Protocol for up to $9.8 million. The settlement agreement was signed after lengthy negotiations between the parties. LifeLabs agreed to pay $4.9 million in guaranteed settlement funds and $4.9 million in contingent settlement funds. Under the settlement, the plaintiffs advanced only their claim of negligence.

Who is Eligible for the Claim?

You may be eligible for the settlement if you live in Canada and were a LifeLabs customer on or before December 17, 2019. You can submit a claim between December 8, 2023, and no later than April 6, 2024. You must also have a valid provincial health card number to prove your identity.

What is the Settlement Amount?

The compensation you will receive depends on the number of claims filed. The minimum amount is $50, and the maximum is $150, minus taxes and court fees. The amount paid per person will be determined based on the total number of claims filed. You can choose to be paid by e-transfer or by cheque. E-transfer is faster and does not incur a processing fee. Cheque payments will have a $2.00 fee deducted.

How to File the Lifelabs Settlement Claim Form?

You can follow the step-by-step procedure given below to submit a claim and get your settlement amount. You can submit a claim in one of three ways.

  1. Go to the official website at lifelabssettlement.kpmg.ca
  2. Click on the Submit a Claim button.
  3. Enter your first name, last name, email address, and phone number in the respective fields.
  4. Enter your provincial health card number in the field labelled Health Card Number. This is required to prove you are a member of the class.
  5. Choose your preferred payment method from the drop-down menu.
  6. If you choose e-transfer, enter your email address again in the Email Address for Interac e-transfer field. If you choose cheque, enter your mailing address in the fields labelled Address.
  7. Review the Declaration and Consent section and check the box to indicate your agreement.
  8. Click on the Submit button to complete your claim. You can submit a claim between December 8, 2023, and April 6, 2024.

Apart from the method mentioned above, claimants can file the claim by following the steps below.

  • Email a completed claim form to the claims administrator at [email protected].
  • Mail a completed claim form to the administrator at the address below.

A bilingual call centre is available for general inquiries and assistance in completing the claim form. The call centre operates Monday to Friday, 8 am – 8 pm EST.
