If you’ve ever received a suspicious tech support call claiming to be from Dell, you’re not alone — and now, you could be eligible for compensation. A Nova Scotia court has approved a $2.1 million class action settlement involving Dell Canada and its U.S. parent company, Dell Technologies. The case stems from a data breach that allegedly enabled scammers to target Dell customers across Canada.

Tens of thousands of Canadians could now qualify for compensation ranging from $85 to $3,000, depending on the type of claim they submit. Here’s a breakdown of who qualifies, how much you could receive, and what steps to take if you think you’re eligible.


What Was the Lawsuit About?

The class action lawsuit was launched by Wagners Law Firm in Nova Scotia. It alleged that Dell failed to adequately protect its customer data, which ultimately resulted in scammers gaining access to personal information and using it to make fraudulent tech support calls.

These scam calls often tricked people into granting remote access to their computers or handing over credit card information, under the false pretense of fixing a Dell-related issue. The Nova Scotia Supreme Court gave verbal approval of the settlement on a Thursday ruling, with the written order still pending.


Who Is Eligible for Compensation?

You may be part of the class action and eligible to claim money if:

  • You received a data breach notification email from Dell on either April 2, 2018 or January 25, 2019.
  • You were sent a notice from Verita Global (the settlement administrator) on November 13, 2024.

How Much Could You Receive?

There are two types of compensation available to class members:

Base Payment – No Proof Required

Every eligible person who submits a claim form will receive a guaranteed $85, regardless of whether they experienced financial loss.

If you suffered direct financial consequences due to the scam — such as fraudulent credit card charges, unauthorized banking activity, or paid for computer repairs — you can apply for reimbursement of up to $3,000.

To qualify for the higher payment, you’ll need to submit supporting documentation such as:

  • Bank or credit card statements
  • Invoices or receipts for computer services

Keep in mind that the final payout may be reduced depending on how many people submit economic loss claims.


When and How to Submit Your Claim

Right now, no action is needed — but that will change soon. According to Wagners, the court must issue the official written approval first. After that, a five-week appeal period will follow.

Once the appeal period ends, Verita Global will email a second notice to eligible participants. This email will contain:

  • Step-by-step instructions for submitting your claim
  • A link to the online distribution form
  • A deadline for submission

Important: If your email address has changed since 2018 or 2019, contact Verita Global immediately to update your information — otherwise, you could miss your opportunity to claim compensation.


What’s the Deadline to Apply?

The exact deadline hasn’t been announced yet. It will be set as 90 days after the second email notice is sent out by Verita Global. That’s why it’s crucial to keep an eye on your email — and don’t forget to check your spam folder just in case.
